Tier 2 Visa Experts
If you have recently employed a talented individual from abroad, you need to ensure that the correct documentation is in place so that your future employee can complete a smooth transition from their country into your business. Similarly, if you are an individual looking to immigrate to the UK to begin work, you need to make sure you have the correct documents to ensure you can start work as soon as possible.
Essentially, Tier 2 visas are for those skilled workers immigrating to the UK, who have a confirmed offer of employment in place with a British company that will act as a sponsor and satisfy certain criteria and responsibilities.
What is a Tier 2 Visa?
In 2008, the UK Border Agency (UKBA) decided to make its immigration laws more stringent by replacing the traditional work permit with a new Tier 2 visa for skilled workers.
Tier 2 Visa is based on a point-based system and is very similar to the Tier 1 Visa. However, the biggest point of differentiation is the individual applying for a Tier 2 Visa must already have an offer of employment from a British company, who is committed to sponsoring the individual.
The Tier 2 Visa applies to certain professions which are deemed to be specialist and highly skilled, such as manufacturing, education and healthcare, attracting a shorter application process. These occupations form part of a list that gives priority to certain sectors and fields. However, if your occupation is not on this shortlist, the onus falls on the business to provide clear and coherent argument as to why the job cannot be carried out by a British Citizen.
Tier 2 Visa Requirements
To qualify for a Tier 2 visa, an individual is required to score points in a skills assessment. Points are awarded for the following:
- Future expected earnings
- English language skills
- Maintenance funds
Within the Tier 2 Visa category there are four visa sub-categories:
- Tier 2 general UK work permit
- Tier 2 intra-company transfer work permits
- Tier 2 visas for sportspeople
- Tier 2 Minister of Religion
How Long Does It Take?
The average Tier 2 visa processing time varies significantly, depending on which country you are applying from and when you apply. This is why it is highly important to seek legal advice with your application, to ensure there are no unnecessary delays.
The UKBA Tier 2 visa application system seems simple and straightforward enough, however, it can be a real minefield for those unaware of how the current immigration rules.
