What is a Tier 2 Visa?

In 2008, the UK Border Agency (UKBA) decided to make its immigration laws more stringent by replacing the traditional work permit with a new Tier 2 visa for skilled workers.

Tier 2 Visa is based on a point-based system and is very similar to the Tier 1 Visa. However, the biggest point of differentiation is the individual applying for a Tier 2 Visa must already have an offer of employment from a British company, who is committed to sponsoring the individual.

The Tier 2 Visa applies to certain professions which are deemed to be specialist and highly skilled, such as manufacturing, education and healthcare, attracting a shorter application process. These occupations form part of a list that gives priority to certain sectors and fields. However, if your occupation is not on this shortlist, the onus falls on the business to provide clear and coherent argument as to why the job cannot be carried out by a British Citizen.

Tier 2 Visa Requirements

To qualify for a Tier 2 visa, an individual is required to score points in a skills assessment. Points are awarded for the following:

  • Qualifications
  • Sponsorship
  • Future expected earnings
  • English language skills
  • Maintenance funds

Within the Tier 2 Visa category there are four visa sub-categories:

  1. Tier 2 general UK work permit
  2. Tier 2 intra-company transfer work permits
  3. Tier 2 visas for sportspeople
  4. Tier 2 Minister of Religion
